Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of AdIntelHQ ("the Service"), operated by Sixpack Design Studio d.o.o. ("we", "us", "our") at adintelhq.io. By registering for or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the Service.

2. Description of Service

AdIntelHQ is an AI-powered marketing intelligence platform that analyzes competitor advertising data and generates marketing campaign suggestions. The Service provides:

• Competitor discovery and analysis
• Ad pattern recognition and reporting
• Market gap identification
• AI-generated campaign content and copy suggestions
• Ad performance scoring

All outputs are AI-generated suggestions based on publicly available information. They do not constitute professional marketing, legal, or financial advice.

3. Account Registration

To use the Service you must create an account. You agree to:

• Provide accurate, current and complete registration information
• Maintain the security of your password
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Subscription Plans and Payment

The Service is offered on a subscription basis with the following plan tiers: Free, Starter, Pro, and Agency. Paid subscriptions are billed monthly in advance through our payment processor, Paddle.

• All prices are in USD and exclusive of any applicable taxes
• Subscriptions automatically renew at the end of each billing period
• You may cancel your subscription at any time; access continues until the end of the paid period
• We reserve the right to change pricing with 30 days notice to existing subscribers

Payments are processed by Paddle, who acts as Merchant of Record. By purchasing a subscription, you also agree to Paddle's Terms of Service.

5. Refunds

Please refer to our Refund Policy for full details. We offer a 14-day refund window on all paid subscriptions.

6. Free Plan

The Free plan provides limited access to the Service at no charge. We reserve the right to modify, limit, or discontinue the Free plan at any time with reasonable notice.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Scrape, crawl, or extract data from the Service using automated means beyond normal use
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Resell, sublicense, or commercially redistribute the Service without our written consent
• Use the Service to generate spam, misleading advertising, or fraudulent content
• Reverse engineer, decompile, or attempt to extract the source code of the Service

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, design, text, graphics, and logos — are owned by Sixpack Design Studio d.o.o. and are protected by applicable intellectual property laws.

AI-generated outputs produced by the Service based on your inputs may be used by you for your own marketing purposes. We retain no claim over such outputs. However, you may not represent AI-generated outputs as independently researched proprietary intelligence for resale.

9. Third-Party Services

The Service uses third-party APIs including Anthropic (AI processing) and Paddle (payments). Your use of the Service is subject to the terms of these providers. We are not responsible for the availability or conduct of third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated outputs will be accurate, complete, or suitable for your specific use case
• Competitor data reflected in the Service is current or exhaustive

Marketing results based on Service outputs depend on many factors outside our control. We make no guarantees of revenue, leads, or campaign performance.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Sixpack Design Studio d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Sixpack Design Studio d.o.o. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is otherwise harmful to the Service, other users, or third parties.

You may terminate your account at any time by contacting us at legal@adintelhq.io. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by the laws of the Republic of Serbia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Belgrade, Serbia.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
